The owner of a building at South Park Mall has sued an affiliate of Elevate Entertainment Group LLC, which planned to build a theater complex at the mall.
Construction on a movie theater and entertainment complex in a portion of a former Sears store at South Park Mall has ground to a halt amid accusations of fraud on the part of the project’s developer and guarantor.
With food court makeover, aquarium and golf course, downtown mall owner tries to create an entertainment hub Mitch Roberts, founder and CEO of Austin-based EVO, which rebranded itself as Elevate Entertainment Group LLC last year, said the company was excited about opening a location at the mall at 2310 S.W. Military Drive. “Unfortunately, while we were working toward opening the theater a dispute arose with the landlord, which has now resulted in litigation.
Leader of San Antonio’s Santikos theater chain stepping down In January, an EVO representative told SP Hwy 35 Investment that EVO had “a funding gap for construction costs” and needed more money from the tenant allowance, the suit states. If the landlord provided more funds to EVO’s contractor, EVO would pay the remaining balance and the project would be finished, the representative said. SP Hwy 35 Investment paid the contractor $1 million, but EVO did not pay what it owed.
