A New Jersey man's attempt to obtain a scouting video of the Rutgers football team was denied in a state appellate court decision.
, again found that Rutgers had the right to deny John Caroff’s request for the “all-22 film” of the Dec. 5, 2020 game. An official in the Rutgers OPRA office denied the request a month later, claiming the all-22 video did not qualify as part of the public record because it would give the Scarlet Knights’ future opponents a “competitive advantage.”
William Gilkison, the Rutgers director of football operations, said in pre-trial certification that the staff records the all-22 video in order to evaluate the team’s “offensive, defensive and scouting team’s plays” after each game. In addition, Rutgers and its upcoming opponent trade copies of their all-22 tapes in “a reciprocal grant of access to the opponents’ proprietary All-22 videos.”
“ believes his daughter ‘possesses the necessary skill set for her to have considerable future career success as a football strategist’ and ‘studying college football All22 video advances her qualifications should she seek future employment with a college football staff or as part of the media covering college football,’” the lawsuit said.
Middlesex County Judge Alberto Rivas denied Caroff’s claim, ruling the OPRA’s proprietary-information exemption applied. He rejected Caroff’s argument that by sharing the all-22 videos with some schools Rutgers opened the door to everyone.
