There has been ongoing dialogue between Kraft’s legal team and Florida state attorney Dave Aronberg’s office since Kraft was charged in February on two misdemeanor solicitation charges, according to the two people, who were granted anonymity because the discussions are private. The diversion form offered to Kraft and the other men charged and obtained by USA TODAY Sports is similar to other such offers in cases prosecuted in Palm Beach County over the last several months. A mandatory prostitution impact course, STD screening, community service and a fine are usually included. But there’s one major difference under the "other" category: "The Defendant must provide a truthful, sworn statement to the State regarding his knowledge of the illicit activity.

"He has to prove the case beyond a reasonable doubt," former assistant U.S. Attorney David S. Weinstein told USA TODAY Sports. "If the video evidence is thrown out and a detective has to testify to what he saw , you're missing what gave the woman money."NEWSLETTERSThank you! "There's always a potential for liability, but I'm not sure it's a winnable case," said Weinstein, a partner at Hinshaw & Culbertson. "He perhaps should have been more concerned about what he was saying. He was going for effect and he netted this huge whale. He got Robert Kraft. There is a human trafficking problem in South Florida, so it was not out of the box to look for it. But they haven't found it.

Mike Edmondson, a spokesperson for the state prosecutor’s office, declined to comment. Edmondson did point to a statement by the National District Attorneys Association issued last month after Chicago prosecutors dropped charges against Jussie Smollett, the actor who allegedly staged a hate crime.
