Maximino Delgado Lagunas was convicted earlier this year of second-degree murder for the death of Grace Aguilar, who he struck and killed during an alcohol-fueled crash.

Lagunas, who was working as a painter at a nearby home, had just left his job site when he apparently lost control of his Toyota 4Runner and drove onto the sidewalk on the opposite side of the street, where Aguilar was playing. After striking Aguilar, Lagunas crashed into a parked car. Based on a subsequent toxicology test, investigators estimated that Lagunas’ blood alcohol level was .22 percent at the time of the crash, nearly three times the legal limit.

Lagunas had been convicted of a previous DUI in Buena Park in 2015. After that conviction, he received a formal warning — known as a Watson advisement — that if he continued to drive while under the influence and struck and killed someone he could be charged with murder.
