It's been seven months since a one-year-old girl was scalded with boiling water and her parents arrested. We have been investigating the case since it happened, finding several cracks in the system that kept the toddler in her parent's care despite several attempts by Child Protective Services to remove her from them. SAN ANTONIO - It's been seven months since a one-year-old girl was scalded with boiling water and her parents arrested.

In November 2023, we started investigating the process of how children are removed from the custody of their parents or legal guardians by Child Protective Services . Since we started, we found out through the state sources that CPS had attempted three times to remove the six Mann children before the 1-year-old was scalded by boiling water.

"It came down to is a lot of communication issues," said Rep. Lujan. "And when you take a child away, and you take it to the DA, and you say, let's take this child, and the DA says, there's not enough evidence there, and sends it back. And then they say, okay, not enough evidence. We just give them back to the family. That's not the way to do things.”The DA's office is in charge of representing CPS' request to remove a child.

According to sources, the Mann case was the more typical of the scenarios where parents are just avoiding CPS and there may not be enough evidence in the opinion of the on-call assistant district attorney to take the case to a judge and request for removal.
