A red flag law allows law enforcement — who must obtain a court order first — to seize someone’s guns temporarily if they’ve been flagged as potentially a danger to themselves or others.can petition a court to temporarily take away someone’s firearms if that person is showing warning signs of violence - even if they don’t have a criminal record or a history of mental illness.
Supporters see red flag legislation as a proactive solution to gun violence after horrific mass shootings in Uvalde, Texas, Buffalo, New York and elsewhere.because often they allow a person to lose their guns without requiring their presence at the initial court hearing., voting to allow confiscation of guns from individuals deemed an “extreme risk” over objections from Republicans. GOP members argued the legislation violates the rights of law-abiding gun owners.
The bipartisan legislation progressing in the Senate could allow money to be distributed to support state-level red flag laws. Texas Sen. John Cornyn, the lead Republican negotiator, fought for Texas and other states without red flag laws to receive equal access to the money available in order to fund alternative crisis intervention approaches such as drug and mental health courts.
Cornyn also insisted on due process requirements that states have to meet in order to be eligible for the funding.
