There is increasing concern that court access to health files may be used to cast doubt on the credibility of rape and sexual assault survivors.

Psychiatrists are becoming increasingly concerned that patient confidentiality is being undermined in Queensland courts, and that access to health files may be used to cast doubt on the credibility of rape and sexual assault survivors.

“Except in the case of Queensland, all states and territories restrict access to communications between health professionals and victims of sexual assault,” RANZCP said in its submission to the Queensland Sentencing Advisory Council. Without medical confidentiality, victims may not seek counselling or report a crime, says the peak psychiatric body.In a separate submission, the Queensland Sexual Assault Network submitted that the courts also needed independent and forensic psychologists who were using standardised and measurable approaches and had experience working with victim survivors.
