Heat index values up to 108 are possible in Central & North Texas . A Heat Advisory is in effect for Milam County through 8 pm Wednesday.A kayaker walks past large buoys being used as a floating border barrier on the Rio Grande . The 5th Circuit Court of Appeals has reversed the injunction in the case of the Texas border buoys, just over a year after they were installed.
Some of the judges wrote in the majority opinion that the U.S. did not present enough evidence that the buoys were interrupting the river navigation or disrupting commercial traffic, and one judge wrote "a sovereign isn't a sovereign if it can't defend itself against invasion." Judges that disagreed with the ruling cite questions about whether the Rio Grande is considered navigable and how the barrier will impact relations with Mexico.
This is not the end of the line for the buoys. This debate goes before Judge David Ezra in U.S. District Court on August 6.The Federal Court of Appeals for the Fifth Circuit just ruled that Texas can KEEP these buoys in the water securing our border.
