This week, Penn State filed a motion in federal court, asking a judge to dismiss an attempt to block the university from buying the Beta Theta Pi fraternity house on campus.alcohol-related hazing event led to the death of Timothy Piazza.Earlier this year, fraternity alum Donald Abbey stepped up his legal battle to stop the sale of the house, claiming the university is trying to defraud him.Both the Centre County and state superior courts issued rulings, allowing Penn State to buy the house.

Abbey cited 2005 e-mails from university administrators indicating that they had no intention of taking over the property. Penn State countered that Abbey made an “out of date argument,” while notes in the court ruling allowing the university to buy the property state that it was also ordered that both sides should negotiate a fair market value, or the sale price would go to arbitration.
