Rosita Diaz, a Paterson resident, was pronounced dead at Paterson Police Headquarters on Feb. 18, 2022, just a few minutes after an officer discovered her unresponsive on a bench in a holding cell, authorities said at the time.
Diaz’s death was investigated by the Office of Public Integrity and Accountability, a division within the attorney general’s office. The investigation included witness interviews, review of body-worn camera and surveillance footage, medical records, as well as autopsy and toxicology results from the state medical examiner, according to a news release. Diaz was taken into custody the day before she died on a charge of possession of crack cocaine, investigators found. In the time between her arrest and death, she was shuttled to a hospital “several times” for unspecified medical issues or clearance for incarceration on medical or psychological grounds, the release said. She was discovered by the officer while awaiting transport to the jail after her last discharge from the hospital. Posthumous toxicological tests showed that Diaz had fentanyl, para-flouro-fentanyl, and cocaine in her system at the time of her death, according to the release. The medical examiner ruled her death an accident. Investigators presented their evidence to the grand jury, which on Monday issued a vote of “no bill,” meaning they decided there was insufficient evidence to support a prosecution.
