The state Supreme Court has agreed to hear two aspects of the appeal of a Northumberland County man who is serving what is tantamount to a life sentence for raping and kidnapping women in three counties between 2012 and 2017.The former state prison guard who police called a serial rapist was designated a sexually violent predator and sentenced to 59 to 280 years in state prison.

Probable cause may be established to support a search warrant to Google requesting the content of an individual’s private Internet search queries where the suspect is unknown and no evidence is presented establishing that Google was used in the planning or commission of the crime.The internet search data was obtained during the state police investigation into the July 19, 2016, kidnapping and rape of a Northumberland County woman while her husband was at work.

On Sept. 14, 2016, police obtained a search warrant directed to Google Inc. for records of searches made for the woman’s name or home address during the week preceding the incident. Kurtz, in a police interview following his arrest, admitted committing the kidnapping and rape. He also incriminated himself in incidents with four other women.He also argued he had a reasonable expectation of privacy over his Google search queries as it is nearly impossible to participate in contemporary society without conducting internet searches.

The Supreme Court order dealt only with the two internet search issues not the others raised by Kurtz that the Superior Court panel had denied.A video of a state police interview during which Kurtz admitted to the rapes and searching the internet for “rape fantasies.
