Cpl. Norman Strauss III contends in a counterclaim filed Monday in U.S. Middle District Court that the death of Hunter W. P. Foust would have been prevented if his father Rodney E. Foust complied with the law regarding guns.

He accuses Foust of being reckless in the supervision of his son by failing to ensure he did not have access to guns. The eighth grader was sent home from Northeast Bradford High School. State police were notified after what he wrote on a computer was considered offensive.arrived at the house and requested to speak with the boy. They left after advising his mother, Angel Bailey, he would be charged criminally.His mother realizing he had taken a handgun, notified his father who drove to the area where he thought his son might be. He observed his son being shot.

When they ordered the boy to drop the gun, he pointed it at one of the troopers who fired three shots. The teen continued to point the gun at the trooper after the first two shots.Foust claims his son never pointed the handgun at or threatened the troopers but had the weapon pointed toward the ground.
