The Department of State is appealing a ruling in Lycoming County that overturned an Office of Open Records decision.

Lehman reviews tally sheets generated from a hand recount of the 2020 results of the races for president and state auditor general.WILLIAMSPORT – The state Department of State has cited 11 errors it claims a judge made in ruling that cast vote records from the 2020 general election in Lycoming County are public.

Linhardt ruled Honey was not entitled to the CVRs because she is not a county resident but he gave access to them to three county Republican conservatives – state Rep. Joseph D. Hamm, GOP chair Donald C. Peters and Jeffrey J. Stroehmann. The Legislature intended to provide broad public access to the documents and records of county boards of election.The release of the CVR does not violate the Pennsylvania Constitution’s guarantee of secrecy of voting as argued by the Department of State.

There is a column for each candidate that was on the ballot and nearly 60,000 rows representing everyone who voted in 2020, he said. A viewer could see for which offices a vote was cast but not who cast it, he said.
