Forty-seven deputies were hired illegally since 2016 despite having failed their psychological evaluations.
Last month a Dublin couple was shot and killed in their home allegedly by an Alameda County Sheriff’s Office deputy with his department-issued weapon after his overtime shift at Santa Rita Jail. Following his arrest, an audit of hires since 2016 revealed that 47 deputies were hired despite having failed their psychological evaluations. The Sheriff’s Office won’t say if the suspect had failed his evaluation, but they confirm that this tragedy prompted the audit.
This is an urgent matter. Last week, 16 deputies already had been deemed psychologically fit and cleared to return. Although the California Commission on Peace Officer Standards and Training is investigating how this happened, only the attorney general has authority to enforce the law and bring criminal charges where appropriate.
Santa Rita Jail has one of the highest in-custody death rates in the Bay Area. Many have involved violent interactions with deputies. The primary and most important duty of any jail is the care and custody of those detained. We now know that 30 of the deputies who failed their psych evaluations worked at Santa Rita Jail and all the rest were subject to mandatory overtime there. It’s important that deputies working anywhere are psychologically fit for duty, but this is critical in a jail.
at the time. “The conduct of these defendants violated the law and there was no rational explanation for their actions aside from abject cruelty and a disregard for the humanity of the inmates.”, psychological evaluations are meant to determine if the candidate is free from any emotional or mental condition, including bias against race or ethnicity, gender, nationality, religion, disability or sexual orientation, that might adversely affect the exercise of the powers of a peace officer.
