PANAMA CITY, Fla. - The open carry ban in Florida has been lifted. As of September 12, the first district court of appeal ruled that the prohibition was unconstitutional. Florida is one of just five states with an open carry ban.

Attorney General James Uthmeier has since advised law enforcement and the Sheriff’s Association on how to proceed. Bay County Sheriff Tommy Ford says he was caught by surprise by the court decision. “So as of right now, and as of when that ruling came out, I’ve instructed our deputies not to enforce the prohibition on open carry. So it is permissible to open carry a firearm in Florida now,” said Sheriff Ford. He says situations like large events or holidays could create challenges for both deputies and citizens, so his office is focused on education. “With a right comes a responsibility, and we would just ask people to become educated on firearm safety and firearms proficiency because we want people to stay safe. But we respect their constitutional rights,” said Sheriff Ford. Deputies will still enforce laws against reckless display of a firearm, trespassing on private property, and assault. Sheriff Ford expects to see an increase in open carry. “I can’t say I’m not concerned in certain situations, spring break, and other mass gatherings, and things like that.
