Ohio Attorney General Dave Yost was more strident, accusing Biden of abusing his presidential pardon power on the eve of an election.
to pardon about 6,500 people with federal convictions for simple marijuana possession and to order a federal review of its classification as a Schedule 1 drug with high potential for abuse and no medical use.
Dan Tierney, a spokesman for Gov. Mike DeWine, said there won’t be a similar move by the governor to pardon people convicted only of simple marijuana possession for multiple reasons. Tierney said Ohio law only allows the governor to issue pardons on a case-by-case basis, rather than issuing a blanket pardon.
“The president’s opinion is what it is,” Tierney said, “but, reviewing his press release, the types of situations he’s talking about, Ohio law does not permit people to be sentenced for those situations.” U.S. Rep. Dave Joyce, a South Russell Republican who co-chairs the Congressional Cannabis Caucus, issued a statement that applauded Biden “for listening and rejecting the all-or-nothing approach demanded by so many in his own party,” and commended him for recognizing the need for state and local expungements. He urged Congress to work on a bipartisan basis to incentivize them.
