Representative Andy Ogle s, a Republican from Tennessee, has introduced a proposed amendment to the U.S. Constitution that would permit President Donald Trump to serve a third term. Ogles' amendment, tailored for Trump, would allow presidents to be elected for a third term only if their first two terms were nonconsecutive. Despite the high constitutional barrier to seeking a third term, Trump has expressed interest in potentially running for another presidency.
Ogles stated in a Thursday press release that Trump 'has proven himself to be the only figure in modern history capable of reversing our nation's decay and restoring America to greatness, and he must be given the time necessary to accomplish that goal.'However, Harvard Law Professor Stephen Sachs, the Antonin Scalia Professor of Law at Harvard, casts significant doubt on Ogles' resolution's viability in Congress, let alone among the states needed for ratification. Sachs emphasized that passing any constitutional amendment is 'very hard.' He explained that Article V of the Constitution mandates a two-thirds vote in both the House and the Senate for an amendment proposal. Following Congressional approval, the proposal then requires ratification by either state legislatures or state conventions, with the choice resting with Congress, in three-fourths of the states.Sachs pointed out that even if Ogles' proposal garnered widespread public support, it would face an even greater challenge due to the requirement of near-unanimous bipartisan support. He stated it's 'impossibly difficult, assuming that it would receive no or very few Democratic votes, either in Congress or in the state legislatures.' Sachs further remarked that Ogles' proposal has attracted 'a great deal more attention than is warranted by its chances of passage.' He bluntly stated that he believes there would be no appetite in Congress or the states for an amendment that would permit a third elected term for presidents who had already served two consecutive terms.
