Supervisors will be redoing the appointment of their new county executive this coming Tuesday
County supervisors in Santa Clara County allegedly broke California government transparency laws, according to a letter from District Attorney Jeffrey Rosen.
The DA states that a violation of the Brown Act, a 1950s-era law governing the public’s access to legislative meetings, occurred. Williams currently serves as the county counsel and is the youngest ever executive to be appointed at 38. He will replace Jeff Smith, who has been CEO since 2009, starting next summer.
According to Smith, this is the first time during his tenure that that the District Attorney’s office has accused supervisors of violating the Brown Act. Williams did not immediately respond to a request for comment. Rosen’s letter, dated Nov. 10, states that supervisors broke the Brown Act in two different ways. First, the agenda from Oct. 17 when supervisors first approved Williams as supervisor in a closed meeting does not mention anything about Williams’ appointment. Second, in his routine report to the board about what occurred during the previous day’s closed session meeting, Williams said during the public board meeting on Oct. 18 that “there were no reportable actions taken.
