A trial is set to begin Monday in North Dakota , more than a year after families of transgender children and a doctor filed a lawsuit arguing that the state's ban on gender-affirming care for minors violates the state's constitution. North Dakota is among over two dozen states that have enacted similar bans. The lawsuit, filed in late 2023, initially included claims from several families and a pediatric endocrinologist. However, court rulings have significantly narrowed the scope of the case.

Earlier this month, a state district judge dismissed some claims and certain families from the lawsuit, leaving only the pediatric endocrinologist as the plaintiff. The trial, expected to last eight days, will be held in Bismarck, the state capital. The judge's ruling remains unknown at this time. The law, signed by then-Gov. Doug Burgum in April 2023 after passing overwhelmingly through the Republican-led Legislature, makes it a misdemeanor for healthcare providers to prescribe or administer hormone treatments or puberty blockers to transgender children and a felony to perform gender-affirming surgery on minors. Supporters of the bill argued that it protects children from irreversible treatments and procedures. Opponents, including healthcare professionals and LGBTQ+ advocates, contend that the legislation harms transgender youth and lacks understanding of the medical necessity of gender-affirming care. They point to research showing higher rates of bullying and suicide attempts among transgender and gender-questioning teens, and highlight that gender-affirming surgeries are not performed on minors in North Dakota. The law does contain an exemption for children already receiving treatments before the ban's effective date. However, attorneys for the plaintiffs argue that providers have hesitated to continue treatment due to perceived vagueness in the law, forcing families to travel and miss work and school to seek care for their children
