Nkomazi mayor leads ANC renegades in fight for reinstatement
Mkhatshwa and the other ANC councillors from Nkomazi, Mkhondo and Msukaligwa have taken the governing party to the Gauteng local division of the High Court arguing that the provincial executive committee and the Gert Sibande regional executive committee did not have the power to charge or expel them from the party because their terms of office had expired.
The three were appointed on an interim basis while the ANC was rectifying a mix-up of the names on the list that was submitted to the Independent Electoral Commission of SA . The PEC, which the national working committee dissolved on March 2 and replaced with a provincial task team, be declared an illegitimate and unlawful structure;
All decisions taken by the Gert Sibande REC to suspend and institute disciplinary action against former Mkhondo mayor Vusi Motha and five other councillors be declared unlawful and set aside.
“This occurrence in Maluti-a-Phofung is [set] to repeat itself in the Nkomazi, Mkhondo and Msukaligwa municipalities, where the erstwhile PEC and REC wanted to impose a mayoral candidate, speaker and chief whip on its councillors, forcing them to violate their consciences by toeing the line and voting for persons who did not meet requirements set out in the ANC’s 2021 local government guidelines.”Despite his expulsion from the ANC, Mkhatshwa is working as a mayor as if nothing has happened.
