A couple is engaged in a heated property boundary dispute after discovering their neighbours built a garden office on land they claim was wrongly allocated due to a developer's fencing error. The homeowners, facing a potential adverse possession claim, are prepared to remove the fence to force a court hearing.
A bitter dispute has erupted in Orleton, Herefordshire, where Justin and Julia Leech, owners of a £600,000 newbuild home, are locked in a boundary conflict with neighbours Craig and Nichola Fleetwood.
The core issue revolves around approximately 17.7 square meters of garden land that the Leechs claim was mistakenly included in their neighbours' property due to a fencing error during the estate's construction by Shropshire Homes. The Leechs, who moved in during November 2023, assert that the neighbours subsequently built a garden office pod on this disputed strip of land.
The couple alleges the property boundary was incorrectly measured from the wrong building, resulting in a 'dog-leg' in the fence line that deviates from all other straight boundaries in the area. Despite repeated attempts to negotiate, the neighbours have refused to engage, leaving the Leechs feeling desperate and considering the drastic step of removing the fence to force a legal resolution.
They fear the neighbours are adopting a wait-and-see strategy, hoping the land will automatically become theirs through adverse possession after ten years. Shropshire Homes acknowledged the fence was installed in the wrong position but stated they reduced the house price by £10,000 and will provide evidence to the Land Registry. The developer maintains the Leechs have no legal right to the land and must maintain the fence, warning against its removal.
With mediation stalled, the Leechs are prepared to seek a court judgment to reclaim what they believe is rightfully theirs, turning their dream home into a prolonged nightmare
