Dr. Margaret Carpenter faces felony charges in Louisiana for allegedly prescribing abortion medication to a patient in another state using telemedicine. This case highlights the ongoing legal battles surrounding abortion access in the wake of the overturning of Roe v. Wade.

A female New York doctor is facing legal action in Louisiana for allegedly prescribing abortion medication via telemedicine. Dr. Margaret Carpenter was indicted in Louisiana on Friday after she is accused of using telemedicine to prescribe abortion medication to a patient. Carpenter, her company, and an associate have been charged with felony criminal abortion by means of abortion-inducing drugs, according to The Associated Press.

This isn't the first time Carpenter has faced accusations of unlawful abortions. Texas filed a lawsuit against her in December, alleging she sent abortion pills to the state. However, she was not charged in that case. New York Governor Kathy Hochul expressed support for the doctor in a statement following the grand jury's decision at the District Court for the Parish of West Baton Rouge in Louisiana. Hochul characterized Dr. Carpenter's actions as 'providing basic health care,' emphasizing that the overturning of Roe v. Wade did not signify the end of anti-abortion politicians' efforts. She highlighted her work with the Legislature to enact leading state laws protecting both providers and patients. Hochul strongly asserted the need for states to safeguard reproductive freedom and vowed to remain steadfast in this fight. New York Attorney General Letitia James also released a statement echoing the stance that abortion care should be recognized as healthcare. James condemned the criminalization of abortion care as a 'direct and brazen attack' on Americans' bodily autonomy and their right to reproductive freedom. She labeled the Louisiana attempt to weaponize the law against out-of-state providers as 'unjust and un-American.' James pledged that New York would not allow individuals to undermine providers' ability to deliver vital care. She emphasized that medication abortion is safe, effective, and essential, and New York will ensure its continued availability to all Americans in need. Louisiana prohibits the use of telemedicine for providing medication abortions. Kristi Noem, recently appointed as the Department of Homeland Security secretary, has previously voiced concerns about telemedicine abortions, citing worries about informed decision-making. Noem stated in 2021, while serving as governor of South Dakota, that liberals had long advocated for abortion decisions being made between a woman and her doctor, but now they were shifting their argument to favor decisions between a woman and 'virtually any stranger over the phone.' She expressed concern that women might not even need to verify the identity or qualifications of the person they consult. The Center for Reproductive Rights reports that Louisiana implements more restrictions on abortion providers than almost any other state. This case appears to be the first instance, since the U.S. Supreme Court overturned Roe v. Wade in 2022, where a doctor has been criminally charged for sending abortion pills to another state, according to the Associated Press
