Elouise McDaniel, 82, of Irvington, is being sued by the township over the number of OPRA requests she has filed.Elouise McDaniel prefers to deal with matters over the phone or via fax machine, but she made an exception last fall when her email pinged with a notification from Irvington Township.
McDaniel — who was accused of several counts including defamation, harassment and malicious abuse of process — told NJ Advance Media on Monday evening that she has a “legal right” to know the information she has requested from the town.“The township does not comment or discuss pending litigation,” said Harold Wiener, municipal clerk in Irvington whom — along with the township — is listed as a plaintiff in the suit.
OPRA requests are intended in part to expand residents’ access to government records, the state’s Government Records Council. People are not restricted on the number of OPRA requests they can submit to an agency. McDaniel, an Irvington resident who taught in Newark for 31 years before retiring in the early 2000s, said if she loses the lawsuit, she will be concerned about the precedent that could be set for residents who send in public records requests.
