John Bailey, 36, was convicted for a 2018 carjacking in which he assaulted a 20-year-old woman, biting her leg and injuring her head and neck before stealing her vehicle, according to the Ocean County Prosecutor’s Office.

Bailey asked the officers to either use plastic ties or ankle cuffs on his wrists, which had been used in the past without hurting him, according to the lawsuit. The officer became irate, shouting obscenities from the front seat as Bailey continued to complain in the back of the van, the suit claims. The lawsuit names law enforcement officers and state officials, accusing them of excessive force and of violating Bailey’s Eighth Amendment civil rights prohibiting cruel and unusual punishment.
The carjacking for which Bailey was convicted occurred in Lakewood on Dec. 5, 2018, when a woman told police a man wearing a face covering smashed her driver’s side window with his fist.
