Elon Musk is fighting back against a class-action lawsuit alleging he defrauded voters into signing a petition for the U.S. Constitution in exchange for a chance to win $1 million per day.

Elon Musk has petitioned a federal judge to dismiss a class-action lawsuit filed by voters who allege he defrauded them into signing a petition in support of the U.S. Constitution for a chance to win his $1 million-a-day giveaway. Musk, in a Friday filing with the Austin, Texas federal court, vehemently denies the claim that the giveaway constituted an illegal lottery, violating Texas law against deceptive trade practices.

Jacqueline McAferty, a resident of Arizona, initiated the lawsuit, asserting that Musk and his political action committee, America PAC, misled voters in seven battleground states by promising a random selection process for winners. Musk, however, maintains that voters were explicitly informed that they would be evaluated for the opportunity to earn $1 million by serving as spokespeople for America PAC. He asserts, 'Make no mistake: an eligible voter's opportunity to earn is not the same thing as a chance to win.' Furthermore, Musk refutes the notion that petition signers suffered any harm by providing their names, addresses, and phone numbers, which they allege Musk and America PAC could potentially sell. The lawsuit was filed on Election Day, November 5, 2024. Notably, a day prior, a Philadelphia judge declined to halt Musk's giveaway, stating that the city's top prosecutor failed to demonstrate that it constituted an illegal lottery. The case, McAferty v Musk et al, is currently pending in the U.S. District Court, Western District of Texas, under case number 24-01346
