With only less than a week left before the contracts of municipal managers are terminated, the Rustenburg Local Municipality has allegedly rushed to its lawyers in a bid to hold on to its municipal manager
.
In a meeting held in Ditsobotla municipality last Tuesday, the provincial deployment committee led by the chairperson of the ANC in the province, Nono Maloyi, resolved that municipal managers, including Makona, must go when their term ends next week.The political management committee, which met in Rustenburg on October 28, also resolved that Makona must go.
City Press has learnt that a finger has also been pointed at certain ANC and EFF councillors in Rustenburg for supporting Makona’s move to seek legal opinion without following the due processes of taking the motion to the council for discussion. According to the circular from Minister Nkosazana Dlamini-Zuma’s office, the employment contract for a municipal manager must be fixed term for up to a maximum of five years or not exceeding a period ending a year after the election of the next council of the municipality.
Insiders say the municipality wants to defy the minister of cooperative governance and traditional affairs, Dr Nkosazana Dlamini-Zuma’s, office by independently extending the contract of the municipal manager without the mandate. But, the lawyer advised the municipality that the contents of the circular were not in all respects in accordance with the legal position.The circular correctly refers to the principle of legality.
