DOTHAN, Ala. - A group of Houston County homeowners has sued State Farm Fire & Casualty Co. and multiple insurance agencies and agents, alleging the insurer improperly denied or underpaid claims tied to wind and hail damage to their homes.
The complaint, filed March 31 in the Circuit Court of Houston County, lists 54 plaintiffs and demands a jury trial. The suit alleges the homeowners were talked into buying the insurance through State Farm and its representatives and that their claims were denied in whole or in part. This lawsuit follows a similar one filed by attorneys a few months ago on behalf of others who made similar claims. According to the recent filing on Tuesday, the homeowners said their losses stem from storm damage to their houses while they were insured under State Farm policies and renewals. The case alleges State Farm and the agents did not provide the type of coverage the plaintiffs thought they were buying — including coverage that would pay to replace a damaged roof — and that State Farm later failed to properly investigate and pay what the homeowners say they were owed after claims were filed. Several sections of the complaint describe similar allegations across different homeowners: that agents told them the policies would cover replacing roofs damaged by wind and hail, but that the policies reduced payments by subtracting an amount for wear and tear . The complaint includes claims tied to damage on various dates from 2023 to 2025, including claims described as occurring March 13, 2025, as well as other dates listed in the lawsuit. Among the addresses cited in individual sections are homes in Dothan and surrounding areas, including a property on Foxfire Drive in Dothan, where the suit alleges wind and hail on that date led to roof and water damage inside the home. The lawsuit accuses agents of failing to get the coverage homeowners requested or failing to explain key limits in the policies. It also alleges State Farm did not have a valid reason to refuse to pay some claims and did not properly investigate. Plaintiffs seek compensatory and punitive damages, as well as damages for emotional distress and/or mental anguish, plus interest and costs. State Farm and other defendants will be given a few weeks to file their response to the claims in this week’s filing, with the lawsuit containing only allegations at this point. The law firms of Buntin, Etheredge and Fowler along with Dothan Law Group attorneys Gantt Pierce, Niki Pierce and Jason Kingry represent the plaintiffs.
