According to court documents, Judge Spiro Cheriogotis dismissed the case on Tuesday after the police detective who investigated the murder in Prichard was a no-show in court.
Jason Hadaway, a Prichard police detective, cited a conflict in not being able to make the preliminary hearing for Welch.The judge granted a request by prosecutors in May to reset it. The judge in June took testimony from a Prichard investigator, but continued the remainder of the hearing so that Hadaway could testify.
Court records show Hadaway was present for a hearing last month, but it was postponed until Tuesday for reasons that are unclear in the court record.An attorney for a co-defendant in the case, Nicholas Mixon, gave up his client’s right to a preliminary hearing last week and agreed to let the case go to a grand jury.He remains at Metro Jail on a hold from the state prison system.Debby washes road away from beneath family: ‘The car was down.
