' John Blume, a capital defense attorney since the 1980s, adds: 'To me, Tyler Robinson's story is one we don't really know yet. It's up to his mitigation specialists to fill in those blanks.
' Robinson, 23, is accused of shooting Charlie Kirk on September 10 at Utah Valley University while Kirk was speaking to a large crowd. If convicted, he could face death by firing squad. For the past nine months, he has been held in a Provo jail with minimal contact with other inmates, interacting mainly with his legal team, a psychological evaluator, and corrections officers.
At his preliminary hearing, starting July 6, prosecutors are expected to present evidence including Robinson's apparent confession to his father, text messages to his transgender lover and roommate stating 'It was me at UVU yesterday. I'm sorry for all of this,' DNA from a rifle left at the scene, and a note found on his keyboard reading 'I had the opportunity to take out Charlie Kirk and I'm going to take it.
' Robinson's lead counsel, Kathryn Nester, previously defended Kouri Richins, a mother accused of poisoning her husband. Other members of his death-penalty defense team include California lawyer Michael Burt, who represented Lyle Menendez and worked on the defenses of serial killer Richard Ramirez and Olympic Park bombing defendant Eric Rudolph. The mitigation specialists, funded by Utah taxpayers, are considered a defense dream team.
Legal experts note that the overwhelming evidence against Robinson makes it crucial to focus on the sentencing phase and humanize him. His lawyers are seeking to delay the hearing in a common tactic to buy time for the extensive mitigation research, which typically takes at least two years.
