The Dallas Cowboys Hall of Famer is suing Marriott for $100 million after an employee accused him of acting inappropriately toward her.

USA Today reported that the hotel said that Irvin flagged down the woman on Feb. 5, and after shaking her hand, had aggressive behavior while telling her she was attractive. It said he “appeared to be visibly intoxicated.”

“Irvin also reached out and touched the victim’s arm during this conversation without her consent, causing her to step back, become visibly uncomfortable,” USA Today said the filing reads. “Irvin then asked the victim whether she knew anything about having ‘a big Black man inside of .’” USA Today said the filing says that Irvin attempted to grab the woman’s hand again and said that he was “sorry if he brought back bad memories.” The woman claims she pulled away again and that Irvin continued to move forward. The filing also reportedly said that two of the woman’s co-workers noticed that she was uncomfortable when she returned to work.He was pulled from Super Bowl coverage after the woman’s allegations, and spoke out for the first time in a press conference Wednesday.

Irvin denied that he acted inappropriately and said his encounter was cordial and lasted about a minute before he headed up to his room alone.
