Brittany Higgins will not be called to give evidence in her own defence in the defamation case brought against her by her old boss Senator Linda Reynolds in a shock development on day twelve of the trial.
'Not obliged to go into oral evidence': Brittany Higgins will not front WA Supreme Court in Linda Reynolds defamation case
Ms Higgins worked for Senator Reynolds at the time the former Liberal staffer was raped by Mr Lehrmann in Reynolds’ ministerial office in 2019 and the case is currently being heard in the WA Supreme Court after multiple rounds of failed mediation. Ms Higgins' lawyer Rachael Young SC told the court she would not need to call her client to the stand to win their case, which largely relies on the defence that Ms Higgins and Mr Sharaz’s statements are substantially true.
"The second is, and for reasons that I'll make in closing, which I won't make now, we don't think we need to call Miss Higgins to satisfy your honour as to being successful in these proceedings.Ms Higgins was originally set to take the stand for five days next week and the decision has avoided a possible showdown between Higgins and her former employer in court.
Senator Reynolds' former chief of staff Fiona Brown had been due to give evidence but was excused on medical grounds, which has also shortened the length of the trial. Earlier on Monday, Senator Reynolds’ Canberra GP was called to give evidence about the then-defence minister’s health crisis around the time of the allegations made by Ms Higgins.
