Franklin County Common Pleas Judge David Young ordered a continuance as the Supreme Court is set to hear Barnes v. Felix next week.
The case deals with the 2016 fatal shooting of Ashtian Barnes in Texas. Barnes was driving his girlfriend’s rental car on the Sam Houston Tollway outside of Houston. Deputy Constable Roberto Felix stopped the car and initiated a traffic stop. Barnes's family said the car moved forward; the officer argued Barnes was trying to flee. Felix jumped on the door sill of the vehicle and fired into the car, striking Barnes twice less than 10 seconds after the officer ordered Barnes out of the car.
U.S. circuit courts are split in moment-of-threat cases such as this, and the lawsuit seeks to have the Supreme Court weigh in on excessive force claims under the Fourth Amendment. Oral Arguments are set for Wednesday, January 22, 2025.
