MCCCD is attempting to resolve a $45 million tax bill, including interest, stemming from a 2016 lawsuit and property tax error that it asserts it was not responsible for. The lawsuit stems from the 2016 case, Qasimyar v.

Maricopa County, where a tax court ruled in favor of property owners who claimed they were incorrectly and erroneously assessed when their properties transitioned from a primary residence to a rental or secondary home, and vice versa. This change of use should have resulted in lower property tax bills. The Arizona Court of Appeals upheld the ruling, agreeing that some property owners were overtaxed, leading to the reassessment of hundreds of thousands of homes and property tax refunds from 2015 to 2021. As a consequence, the county now needs to repay $329 million in property tax refunds.MCCCD maintains that it played no role in the Qasimyar lawsuit and was not informed that it would be held financially responsible for the outcome. The district states that the county's failure to disclose its intentions prevented MCCCD from adequately planning its budget for the fiscal year 2024-2025. Susan Bitter Smith, MCCCD's Governing Board President, expressed frustration and anxiety regarding the situation, highlighting the limited options available to the district due to the county's lack of notification. MCCCD filed a Notice of Claim against the County in September 2024, giving the County 60 days to respond before further legal action was taken. While Maricopa County declined to comment on the ongoing litigation, the Board of Supervisors approved funding in August 2024 to assist certain taxing districts in covering their tax bills related to the lawsuit. This funding includes $10 million for fire districts and $4 million for lighting and maintenance improvement districts not affiliated with a city or town but impacted by the court decision.
