Maximum Security will not run in the Preakness Stakes, according to his owner, who also said he plans to appeal the horse’s disqualification as the Kentucky Derby winner.

“Churchill Downs, because they are a greedy organization, [doesn’t run] 14 [in the Kentucky Derby] like you have in the Kentucky Oaks, Breeders Cup and just about every other race in America,” West said. “Just because they can make more money, they are willing to risk horses’ lives and peoples’ lives to do that. I’m not a fan of that. I think they ought to have 14 like every other race.

Many had hoped to see Maximum Security and Country House in less than two weeks at the Preakness, but West ended that possibility.“We are not going to run in the Preakness,” West said. “There is no Triple Crown on the line for us and there is no reason to run a horse back in two weeks when you don’t have to.”

West has two obstacles to clear after the appeal is filed, according to Darrell Vienna, a former trainer who is now an attorney specializing in equine law. Kentucky regulations have exceptions that may not allow for the disqualification to be subject to an appeal. “I think it’s probably 50-50 that they get past the first hurdle, or maybe 60-40 in their favor,” said Vienna, who practices in Southern California but has researched Kentucky law and regulations. “I’m certain there are some arguments to overcome this.”“The actual appeal is just going to be a competition of experts,” Vienna said. “The stewards would say how many races they’ve watched and how many disqualifications they’ve done.
