Videos show Lee wearing a Maryland flag-patterned gaiter over his face outside the Capitol. He also wore a military-style medical bag attached to his clothes. Defense attorney Terrell Roberts III said the assault charge in this case only applies to acts involving physical contact with the assault victim.“It would be bad policy to send a man to prison where the evidence fails to prove each element of an offense,” he wrote before the trial.
