A Texas man has filed a lawsuit claiming he contracted a parasitic illness after eating at a Taco Bell in Ohio during a multistate Cyclospora outbreak.
YOUNGSTOWN, Ohio — A Texas man has filed a lawsuit claiming he contracted a parasitic illness after eating at a Taco Bell in Ohio during a multistate Cyclospora outbreak. The complaint, filed Friday in Mahoning County Common Pleas Court, alleges David Ott became ill after eating Taco Supremes on June 18 and June 20 at the Taco Bell on North Canfield-Niles Road in Youngstown.
The lawsuit names Taco Bell Corp., Taylor Fresh Foods Inc., doing business as Taylor Farms, and Charter Foods Inc., the franchise operator, as defendants. According to the lawsuit, Ott developed severe gastrointestinal symptoms on June 22 and was hospitalized for two days. The complaint says testing confirmed he had Cyclospora, a parasite that can cause prolonged diarrhea, abdominal pain, nausea and fatigue. Ott alleges he continues to recover and has incurred medical expenses and lost wages.
The lawsuit alleges health officials traced the outbreak to shredded iceberg lettuce supplied by Taylor Farms to Taco Bell restaurants in several Midwest states. It cites reports that thousands of Cyclospora cases have been identified since May, with Ohio among the states affected. Ott is seeking more than $25,000 in compensatory damages, punitive damages, attorney fees and other relief. The complaint includes claims of product liability, supplier liability, negligence and breach of implied warranties.
