Timothy Paul Fitzgerald was found guilty of multiple charges, including assault, sodomy, sexual abuse, kidnapping, attempted rape, and unlawful sexual penetration, after attacking a homeless and disabled woman sleeping on a Beaverton sidewalk.

A man has been convicted for the violent physical and sexual assault of a wheelchair-bound woman in Beaverton . 'She had come to downtown Beaverton to go to sleep for the night and had gone to sleep on a public sidewalk in downtown Beaverton off of Lombard Avenue,' said Alyssa Camp, the deputy district attorney on this case.

A Washington County jury found Timothy Paul Fitzgerald, 54, guilty of multiple charges, including assault in the first and second degrees, two counts of sodomy in the first degree, three counts of sexual abuse in the first degree, kidnapping in the first degree, attempted rape in the first degree, and unlawful sexual penetration in the first degree. According to prosecutors, Fitzgerald approached a homeless and physically disabled woman while she was sleeping on a sidewalk in downtown Beaverton. After offering her money, which she declined, Fitzgerald attacked her, striking and kicking her in the face with steel-toed boots, causing a complex fracture of her nasal and orbital bones. The victim testified that Fitzgerald then moved her to a more secluded area nearby, where he physically and sexually assaulted her for approximately 40 minutes. She said she could not escape because she was confined to a wheelchair and unable to move quickly enough to get away. Much of the crime was captured on surveillance video from a nearby business. The attack was interrupted by a street sweeper who entered the parking lot where the assault was taking place. 'Very fortunately there was a street sweeper that was assigned to work in the parking lot that they were in. It was a closed shopping center at the time, being after midnight. He had driven in to do his street sweeping duties that night and shown his headlights on where the assault was occurring. And Mr. Fitzgerald then abruptly left the scene,' said Camp. Prosecutors say Fitzgerald fled the scene but was apprehended by police at the Beaverton Transit Center about 10 minutes later. He told officers he did not remember anything after offering the victim money and allowed investigators to swab his body for DNA. The samples confirmed the presence of the victim’s DNA on Fitzgerald. Fitzgerald was also indicted on a charge of bias crime in the first degree, but the judge removed that count from jury consideration, issuing a judgment of acquittal. The judge found that no reasonable jury could conclude Fitzgerald targeted the victim because of her disability. The Washington County District Attorney’s Office commended the victim for her bravery in participating in the legal process and thanked the Beaverton Police Department and the Oregon State Police Forensic Laboratory for their work on the case
