Duran Gilbert was arrested for aggravated assault after allegedly pointing a firearm with a green laser at a McDonald's manager during a refund dispute.
At approximately 11:45 p.m. on Monday, the Indian River County Sheriff's Office responded to a call reporting a weapon being displayed at a McDonald's restaurant. According to the McDonald's manager, a customer, later identified as Duran Gilbert, became agitated over a mistaken order and demanded a refund. The manager stated she tried to resolve the situation by offering additional food, but Gilbert persisted in his demand for a refund.
Suspecting Gilbert might be attempting to defraud her with an old receipt, the manager ultimately offered the refund. After receiving the refund, Gilbert allegedly banged on the drive-thru window and pointed a firearm equipped with a green laser at the manager, causing her to fear for her safety. A McDonald's employee corroborated the verbal altercation but reported not witnessing the firearm. The Real Time Crime Center pinpointed a suspect vehicle based on the manager's description, leading deputies to Gilbert's residence. Both the manager and employee identified Gilbert, resulting in his arrest. During the arrest, Gilbert was informed of his Miranda rights and acknowledged them but chose not to speak. However, the arresting deputy stated that Gilbert admitted to being present at the scene and being involved in the verbal dispute. A search warrant was executed on Gilbert's vehicle, revealing a large green laser pointer but no firearm.
