Dr. Margaret Carpenter, her company Nightingale Medical, PC, and a third person were charged with criminal abortion by means of abortion-inducing drugs, a felony.

Wade, Louisiana has implemented a near-total abortion ban with no exceptions for rape or incest. Physicians convicted of performing an illegal abortion, including one using pills, face up to 15 years in prison, a $200,000 fine, and the revocation of their medical license. Carpenter's company, the Center for Reproductive Rights, condemned the indictment, stating, 'Since Roe v. Wade was overturned, we’ve witnessed a disturbing pattern of interference with women’s rights. It’s no secret the United States has a history of violence and harassment against abortion providers, and this state-sponsored effort to prosecute a doctor providing safe and effective care should alarm everyone.'This case could be the first direct test of New York's shield laws, designed to protect healthcare providers who use telehealth to prescribe abortion pills to patients in states where abortion is banned. New York Governor Kathy Hochul emphasized the ongoing efforts to protect abortion providers and patients, stating, 'We always knew that overturning Roe v. Wade wasn’t the end of the road for anti-abortion politicians. That’s why I worked with the Legislature to pass nation-leading laws to protect providers and patients.' Meanwhile, the pills have become the most prevalent method of abortion in the U.S., accounting for nearly two-thirds of all abortions by 2023. They remain at the heart of political and legal battles surrounding abortion access. In January, a judge allowed three states to continue challenging federal approvals for the prescribing practices of one of the drugs commonly used in medication abortions. The Department of Justice and states are engaged in ongoing court battles over the right to abortion, as defined by the Supreme Court in Roe v. Wade. However, the 1992 Planned Parenthood v. Casey case, which received less attention, opened the door for some abortion restrictions as long as they didn't create an 'undue burden.
