The woman worked at the Edison facility for about 18 years before being injured, investigators said.
The US Attorney’s Office filed a lawsuit Friday alleging that a Middlesex County long-term care facility violated the Americans with Disabilities Act when it fired an employee who could no longer lift heavy objects.
Before sustaining an injury that caused a permanent lifting impairment, the employee had worked at the Roosevelt Care Centers in Edison for about 18 years and was able to perform the essential functions of her job, the office said., terminated the dietary worker’s employment due to her disability without engaging in an interactive process to provide her with a reasonable accommodation, federal prosecutors alleged. Her disability inhibited her ability to lift objects heavier than 18 pounds.
Title I of the ADA prohibits employers from discriminating against a qualified individual on the basis of disability in regard to the hiring, advancement or discharge of employees; employee compensation; and other terms, conditions, or privileges of employment, officials said. “No one should be denied their right to work because of a disability,” U.S. Attorney Philip R. Sellinger said in a statement. “The Americans with Disabilities Act was enacted to prohibit employers from denying employment to people with disabilities without making a reasonable accommodation. The U.S. Attorney’s Office is committed to protecting the civil rights and ensuring equal employment opportunities for all individuals with disabilities.
An official from the Middlesex County Improvement Authority could not immediately be reached for comment.
