Special education students already have a right to private placement under the Individuals with Disabilities Education Act. Far from discrimination, this is state law reflecting federal precedent. Additionally, Texas has criminally discriminated against special education students for decades after placing an illegal cap on special education enrollment, presumably to improve performance metrics.

Yes, we must more intentionally invest in our public schools to better serve special education students. But change does not happen overnight, and special education families seeking alternatives have done their homework. The Supreme Court needs to develop ethics rules to prohibit this type of passive influence before I, for one, will believe they are making constitutional decisions in good faith. I write this letter to raise awareness on behalf of everyone — every victim, survivor, community, city and state, and my family as well. Take action now for the sake of greater good.
