Letter: Utah injunctions bill would go far beyond staying the right to abortion

By Emmylou N. Manwill | The Public ForumAs a born and raised Utahn I’m upset that the Utah Legislature is trying to eradicate my remedies under the law by. But as an attorney, I am horrified by the blatant politicization of the judicial process.

Utah courts have long prided themselves on having a more protective system of our individual rights than even the U.S. Constitution requires. Courts put preliminary injunctions in place to protect our rights when a law that is questionable under the state or U.S. Constitution is passed, while the courts decide if the law should go into effect.

These injunctions are temporary for a reason — they give courts time to analyze the law and do their job. Loosening the system that protects all of our rights simply to eradicate abortion is not seeing the forest through the trees. HJR2′s effect will go far beyond staying the right to abortion. It is a bad law in its breadth. And it is a hyperpartisan political body moving in on the apolitical court process.

I hope the Utah Senate comes to its senses and lets the courts do what they are dictated to do: decide if laws are constitutional and allow temporary remedies to remain in place for affected parties.
