Fernuk asked a store clerk to borrow a phone charger but was denied because he didn’t have the money to buy one. Daniels, high on meth, offered him his jacket and walked with him to the city’s east side. Defence lawyer Blaine Beaven argued that Daniels’s DNA could have transferred from the jacket to the fire poker in Fernuk’s apartment.that the transfer was “theoretically possible,” but unlikely, especially because it wasn’t blood.
“He made a poor decision that night to befriend you and allow you to walk home with him. That poor decision ultimately led to his death.”
