Lawyers presented closing arguments Friday in the sexual assault trial of former WHL coach Bernie Lynch.
The defence lawyer asked the judge to consider the plausibility of the allegations. It was agreed his client had only briefly met the complainant before, and Hitchcock tried to draw attention to the seemingly rash nature of the actions attributed to Lynch, some of which would’ve potentially drawn public attention.Here, White cautioned the judge, noting it would be naive to think crime doesn’t involve some element of risk.
Further, there was the overarching “culture of silence” in the sport of hockey that discouraged people coming forward about being mistreated, he offered. Lynch acknowledged this to be true in his own testimony. “It’s up to us to apply reason,” the defence lawyer said, asking the judge to consider his client’s circumstance.
The inference the court can and should draw, White said, is that the change had something to do with the school and the Pats, for whom he no longer wished to play.“Bernie Lynch, someone he trusted. He says it was Bernie, and he was unshaken on that point,” White said.
