Over 40 lawsuits challenge the Trump-Musk administration's actions, from DOGE's Treasury takeover to an attempted purge of the FBI. The judiciary appears to be holding the line, with Trump losing on several key issues. Despite attempts to disregard unfavorable rulings, the courts are proving to be a crucial check on executive power.
If the theme of the first week of the Elon Musk and Donald Trump autocoup was “Why isn’t anyone doing anything to stop this?” then the theme of this past week was “.” The Trump administration has been hit with over 40 lawsuits challenging everything from DOGE’s takeover of the Treasury to the “Fork in the Road” fake buyout scheme for federal employees. And the scoreboard is, thus far, tilting in favor of the rule of law .
Would they take birthright citizenship? Yes. Would they possibly take the impoundment cases? Yes. But they cannot possibly address all the other cases. Not because they wouldn’t want to, but they are simply not equipped to be a court of appeals over all of these cases. In which case, the decision of the last court of appeals will stand, which is why it’s worth noting a lot of these cases are being brought in the District of Columbia.
Then there are challenges to the so-called temporary pause on grants and federal loans, with the associated questions about impoundment. So that’s four buckets. I don’t for the life of me know what hasn’t been challenged, but once an unlawful action is announced, there is a mobilization of lawyers going into court. It seems to me that there are three explanations for what they’re doing. One is that they don’t even realize that it’s illegal—that’s hard to believe.
