U.S. District Court Judge Robert Kirsch granted Kyocera’s request for a temporary restraining order in August, prompting the New Jersey Treasury Department to halt any further implementation as it continues to defend the law in court., Kirsh said Kyocera “is likely to succeed on the merits of its claims that is unconstitutional” and “the public good is served by an entry of a temporary restraining order.
