A lawsuit was filed against the Iron County School District, alleging it failed to protect one of its students from racism, discrimination, and bullying. The lawsuit was filed on Jan. 13 by a mother and father on behalf of their minor daughter.
They accused the school of failing to respond, intervene, or protect their child.She was on the school's cheerleading team her freshman year, but when she went to try out again the following year, she was "subjected to racism taunts, bullying, and harassment as a result," the lawsuit states. She was reportedly belittled and bullied during her freshman year as well, but was still determined to try out. At one point, she sent the following message to another cheerleader, hoping to resolve lingering tension and start the season on a positive note, assuming they both made the team:The lawsuit contained screenshots of the conversation, which included the response from the other girl: "ur not gonna make the team, your not good enough, and ur to ugly ... ur to ugly to be a cheerleader ... like did your parents even mean to have u"The girl reported the incident to a school counselor, but did not disclose who it involved, as she was concerned it would "adversely impact her chances of making the cheer team," the lawsuit states. She sent screenshots of the conversation to the counselor and, with the counselor's permission, deleted the messages from her phone. "Little did that well-meaning counselor know that such permission would lead the to shirk its responsibilities and fail to address the racism and bullying in any meaningful way," the lawsuit states. Although the girl did not disclose that she was the one receiving the messages, the counselor and vice principal suspected she was and contacted her parents, who were able to provide confirmation. The other girl and her parents were confronted about the text messages, but claimed her phone had been "hacked." Later, they allegedly denied that the conversation occurred in the first place and accused the first girl of fabricating the conversation, as there was no proof it happened.The parents reportedly pressed the school district to take action and protect their daughter, but said the school district continually failed. The lawsuit also accused the school district of violating Utah State Code Section 53G-9-605.5, which requires the creation of a Bullying Incident Action plan. In the lawsuit, the parents stated that they felt forced to turn to the Cedar City Police Department for help due to the lack of response from the school district. However, the police department stated that the school resource officer and cheer coach were the only ones who could take action. The parents went to the administration once more, but said their concerns were again dismissed. They accused the cheer coach of siding with the other girl, saying the coach "went to lengths" to defend her and refused to take disciplinary action.
