A lawsuit against Kia and Hyundai is moving forward after a man died in a crash involving a stolen Kia. The suit alleges the automakers were negligent in failing to address design flaws that made their vehicles easily stolen. The family of the deceased and a severely injured man are represented by Schiff and Associates. The automakers' appeal was denied, paving the way for a jury trial.
Matthew Moshi, 36, died on Nov. 27, 2023, after he was critically injured over the weekend at the intersection of Beacon Hill and Hilliard-Rome Road. , a father of two, lost his life in a crash involving a stolen Kia , a federal lawsuit against Kia America and Hyundai is moving forward.
The lawsuit, filed by Columbus law firm Schiff and Associates, on behalf of Moshi's family and a Columbus man severely injured in a similar incident involving a stolen Hyundai, alleges the automakers were negligent under Ohio law for failing to address design flaws that allowed thieves to easily steal the vehicles."Lots of people have been injured by stolen Hyundais and Kias, and we are trying to help those people recover what they deserve," said Terry Hummel, head of litigation with Schiff & Associates."The cars were manufactured by Kia and Hyundai with defective starting mechanisms, engine immobilizers, which keep the cars from being stolen and they didn't include those in these cars. "They intentionally designed something defective to save money at the risk of the public's safety," said Scott Schiff, founding partner of Schiff & Associates. Initially dismissed, the plaintiffs won on appeal, and an appeals judge on Thursday denied an appeal by the automakers, ordering hearings that will set the jury trial in motion.ABC 6 reached out to Kia America and Hyundai for comment, but has yet to receive a response.
