Pengasas Country Heights Holdings Berhad, Tan Sri Lee Kim Yew akan mencabar pengisytiharan muflis yang dikemukakan terhadapnya.
Katanya, beliau diminta untuk menyerahkan penyata hal ehwal kepada Jabatan Insolvensi Malaysia dalam tempoh 21 hari daripada 17 April lalu.
“Pada 17 April, saya sendiri ke MDI dan mengisi sebab-sebab kemuflisan saya selepas mengakui menerima notis mereka.“Kini saya hanya perlu fokus untuk mengemukakan penyata hal ehwal saya dan saya tidak akan menangguhkan penyerahannya,” katanya. Notis kebankrapan itu difailkan oleh seorang warganegara Amerika Syarikat yang bernama Gerald Patrick Healy iaitu bekas pekerja sebuah syarikat miliknya di AS bernama Club Excellence Inc..
“Beliau sendiri tidak pasti bagaimana untuk menjelaskan maksud ‘alter-ego’ dari segi undang-undang,” katanya. Bagaimanapun, doktrin ‘alter ego’ yang juga dikenali sebagai ‘piercing the corporate veil’ di mana individu mungkin bertanggungjawab ke atas tindakan syarikat mereka dalam keadaan tertentu. “Healy kemudiannya memperoleh penghakiman yang memihak kepadanya dan memfailkan petisyen pemiutang terhadapnya di Mahkamah Tinggi Malaysia pada Ogos 2020,” katanya.
