A Justice Department investigation found Yale University has violated federal civil rights law by illegally discriminating against Asian American and white applicants as the Trump administration has continued to challenge race-based admissions policies at elite universities.
The Justice Department ordered Yale to immediately stop using race or nationality as a factor for future admissions and said, if Yale doesn’t comply, the university must submit a plan to the department “demonstrating its proposal is narrowly tailored as required by law, including by identifying a date for the end of race discrimination.
In 2018, the Trump administration rescinded multiple Obama-era policy guidelines on affirmative action, saying they “advocate policy preferences and positions beyond the requirements of the Constitution.” In 2019, U.S. District Court Judge Allison Burroughs sided with Harvard University in a case that’s widely believed to present an opportunity on appeal for the conservative-leaning Supreme Court to rule against affirmative action.
